Elon Musk’s xAI Files Lawsuit Against OpenAI Over Employee Poaching and Trade Secret Allegations

The complaint charges that OpenAI attempted to gain an unfair advantage in the race to develop AI technology by illegally inducing such employees to breach their confidentiality agreements and other commitments to xAI.

Elon Musk’s AI startup, xAI, has initiated legal action against OpenAI in the United States District Court for the Northern District of California. The lawsuit, filed on Wednesday, 23 September, accuses OpenAI of following a “deeply troubling pattern” of hiring former xAI employees to gain access to trade secrets related to xAI’s chatbot, Grok.

The complaint charges that OpenAI attempted to gain an unfair advantage in the race to develop AI technology by illegally inducing such employees to breach their confidentiality agreements and other commitments to xAI.

“OpenAI is targeting those individuals with knowledge of xAI’s key technologies and business plans, including xAI’s source code and its operational advantages in launching data centres, then inducing those employees to breach their confidentiality and other obligations to xAI through unlawful means,” the lawsuit states.

This is the newest in Musk's string of lawsuits against his ex-business partner, Sam Altman, after a series of suits against OpenAI in recent years. The complaint states that xAI uncovered the purported scheme while investigating allegations of trade secret misappropriation by ex-engineer Xuechen Li, who is accused in another suit of pilfering confidential information from OpenAI.

The suit also identifies an unnamed high-ranking finance executive and ex-business engineer Jimmy Fraiture as people purportedly brought in by OpenAI to review xAI trade secrets. It attached a screenshot of the July email sent to a previous xAI executive, which was received by Alex Spiro, attorney for Musk and xAI, alleging that the person had violated confidentiality agreements.

Talking about the lawsuit through a post on X, Musk said, "We issued them numerous warning letters, but they kept cheating. Lawsuit was the sole recourse after trying all others."

Musk, a party to several lawsuits both plaintiff and defendant, recently brought actions against OpenAI and Apple alleging anti-competitive behavior and Apple's bias towards ChatGPT in its App Store. The complaint asserts a "conspiracy to monopolise the markets for smartphones and generative AI chatbots."

Musk and Altman also founded OpenAI in 2015, but Musk resigned from the board in 2018 after a failed coup attempt on the organisation. Last month, OpenAI spurned Musk's $97.4 billion offer to buy out the nonprofit. OpenAI Board Chairman Bret Taylor in February referred to the bid on X as "an attempt to disrupt his competition," saying, "OpenAI is not for sale, and the board has unanimously rejected Mr Musk's latest attempt to disrupt his competition."
